Supreme Court Ruling on Local Government Finances Criticized by Former Delta State Governor

ABUJA/Nigeria: Former Governor of Delta State, Chief James Onanefe Ibori, has strongly criticized a recent Supreme Court judgment, describing it as a severe blow to the principles of federalism enshrined in Nigeria’s constitution. The judgment, delivered earlier today, allows for federal intervention in local government finances, a move Ibori contends undermines the autonomy of states and local governments.

In his reaction to the ruling, Ibori emphasized the constitutional provisions governing the distribution of funds among the tiers of government, as outlined in Section 162(3) of the 1999 Constitution. He argued that the decision to permit federal interference in local government finances contradicts these provisions and sets a dangerous precedent for centralized control from the federal level.

“The Supreme Court’s decision is an assault on true federalism,” Ibori stated. “It grants the federal government undue authority over local government administration, which is against the core principles of our federal system.”

Ibori acknowledged concerns over mismanagement of local government funds by some state governors but maintained that such issues should be addressed within the framework of state governance, without federal intervention. He cautioned that the ruling could weaken state autonomy and financial independence, potentially politicizing the distribution of funds meant for local development.

Key issues raised by Ibori include questions on the judiciary’s role in interpreting constitutional provisions and the broader implications for the balance of power between federal and state governments. He expressed hope for a review of the judgment, stressing the need to uphold the integrity of Nigeria’s federal structure.

“As we reflect on this ruling in the coming days, it’s crucial to consider its far-reaching implications,” Ibori remarked. “We must protect the constitutional rights of states to manage their local affairs independently, without undue interference.”

In conclusion, Ibori quoted the late Hon. Justice Oputa, emphasizing the fallibility of judicial decisions and the importance of upholding constitutional principles in safeguarding federalism.
