2027: Orette Challenges INEC Over Exclusion From Delta South Candidate List

ABUJA/Nigeria: A fresh legal dispute has emerged over the African Democratic Congress (ADC) ticket for the Delta South Senatorial District ahead of the 2027 election, following a suit filed by Dr. Austin Orette against the Independent National Electoral Commission (INEC).

Orette, a Nigerian-American family medicine physician and politician, is asking the Federal High Court in Abuja to compel INEC to recognise and publish his name as the ADC candidate for the Delta South senatorial election scheduled for January 16, 2027.

INEC and the ADC are listed as the first and second defendants respectively in the suit filed through Orette’s counsel, James Olotu.

At the centre of the dispute is Orette’s claim that he won the ADC senatorial primary conducted on May 22, 2026, after which, according to his court filing, the party submitted his name to INEC on July 14 for the Delta South contest.

He is challenging the subsequent omission of his name from the final list of candidates published by INEC on September 12, 2026.

Orette is asking the court to determine whether, having emerged from the party’s primary as its nominee and following the alleged submission of his name to INEC, the electoral commission could lawfully exclude him from the published list.

The plaintiff is also seeking a declaration that the omission of his name from the final candidate list was unlawful, null and void.

Among the reliefs sought is an order directing INEC to list him as the ADC candidate for the Delta South Senatorial District election, or for the election whenever it is held.

Orette’s case is anchored on provisions of the 1999 Constitution, as amended, the Electoral Act 2026, the Federal High Court Civil Procedure Rules and the court’s pre-election practice directions, according to the court filing.

The politician contends that his emergence from the ADC primary and the subsequent communication of his nomination to INEC created a legal basis for his inclusion in the final list.

The case introduces another layer to the political contest for the Delta South senatorial seat, coming after Orette’s campaign organisation had earlier protested his absence from INEC’s published list and maintained that he remained the ADC candidate. orette.org
